CONTINUING DOMESTIC VIOLENCE!

Violence, which is a crime with the threat of a light sentence, currently occurs in almost all lines of life, it cannot be separated from happening in the household. The household is a manifestation of the existence of a relationship between men and women who live together who are tied in legally valid marriage ties. In a household, of course, if God Almighty grants it, children will be born as a result of marriage. It turns out that in the course of marriage itself it is not easy to build a harmonious relationship, because problems that arise threaten its integrity. The most dominant problem is financial problems, the rest is due to disloyalty to the partner which ultimately results in an affair.

Marriage itself is actually sacred and it is not easy to make it happen because it must be equipped with many factors as support, be it age, physical and mental readiness, sufficient finances and so on. Marriage law rules already exist, namely Law Number 1 of 1974 concerning Marriage and Government Regulation Number 9 of 1975 and the Compilation of Islamic Law Presidential Instruction Number 1 of 1991. It turns out that marriage is one of the sources of violent crimes that can undermine the foundations of national and state life. A healthy and strong family will make the nation strong.
Of course, the emergence of violence in marriage cannot be allowed to go unpunished. Then a legal regulation was issued, namely Law Number 23 of 2004 concerning the Elimination of Domestic Violence, the aim of which is of course to hope that there will be no violence and that marriages will run normally and be full of love. What a prostitute turns out to be is not enough to fortify the marriage. Violence after violence continues to occur, the violence here is not only physical but also verbal/word violence and there is also economic violence. Many reports of domestic violence show that marriages that have taken place are not going well. However, it is very unfortunate that the penalties imposed on perpetrators of domestic violence are very light and do not frighten further perpetrators of domestic violence. As the news obtained, namely “…According to data from the Ministry of PPPA, until October 2022 there were 18,261 cases of domestic violence throughout Indonesia, 79.5% or 16,745 of the victims were women. Apart from this data, what we can highlight from the data from the Ministry of PPPA is that domestic violence also affected 2,948 men who became victims…(Source Metrotvnews.com).”

Indeed, it is very difficult to determine strict punishments for perpetrators of domestic violence, many things are considered by judges in trying and deciding. The maximum punishment that should be imposed on the perpetrators and can be used as a touchstone of how effective the Law on the Elimination of Domestic Violence is. The goal of enforcing the law will not be achieved if the crime of domestic violence continues to exist and is increasing and expanding to all regions in this country.
